Terms of Service

ConstructXT Pro grants you a limited, non-exclusive, non-transferable license to access and use the Service for your legitimate construction management business purposes, subject to these Terms.

You must be at least 18 years of age to use the Service. By using the Service, you represent that you meet this requirement.

You are responsible for maintaining the confidentiality of your account credentials. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your login credentials
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activity that occurs under your account

You may not share your account credentials with others or allow unauthorized parties to access the Service through your account.

ConstructXT Pro is a subscription-based service. After your free trial period, continued use of the Service requires a paid subscription at the rates displayed on our pricing page.

• Subscriptions are billed monthly unless otherwise specified
• Billing is processed at the beginning of each billing cycle
• You authorize us to charge your payment method on a recurring basis
• Subscription fees are non-refundable except as required by applicable law
• We reserve the right to change pricing with 30 days advance notice

New accounts receive a 14-day free trial with full access to the Service. No credit card is required to begin the trial. At the end of the trial period, continued use requires a paid subscription. We reserve the right to modify trial terms at any time.

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Upload or transmit harmful, fraudulent, or illegal content
• Infringe on the intellectual property rights of others
• Attempt to gain unauthorized access to any system or network
• Interfere with or disrupt the Service or its infrastructure
• Transmit spam, unsolicited communications, or malware
• Resell or sublicense access to the Service without our written consent

You retain full ownership of all content you upload or create within the Service, including project data, documents, photos, and other materials ("User Content").

By uploading User Content, you grant us a limited license to store, process, and display it solely for the purpose of providing the Service to you. We do not claim ownership of your User Content and will not use it for any other purpose without your consent.

You are solely responsible for the accuracy, legality, and appropriateness of User Content you upload to the Service.

The Service, including its software, design, features, and content (excluding User Content), is owned by ConstructXT Pro and protected by applicable intellectual property laws. Nothing in these Terms transfers any intellectual property rights in the Service to you.

The ConstructXT Pro name, logo, and related marks are trademarks of ConstructXT Pro. You may not use these marks without our prior written consent.

We strive to maintain high availability of the Service, but we do not guarantee uninterrupted access. The Service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice.

To the maximum extent permitted by applicable law, ConstructXT Pro shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business, arising from your use of or inability to use the Service.

Our total liability for any claim related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

You agree to indemnify and hold harmless ConstructXT Pro and its officers, employees, and contractors from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.

You may terminate your account at any time by canceling your subscription through your account settings or by contacting us. Upon termination:

• Your access to the Service will cease at the end of your current billing period
• We will retain your data for a reasonable period to allow for reactivation
• After that retention period, your data will be deleted from our systems

We reserve the right to terminate or suspend your account for violations of these Terms, with or without notice.

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts located in Texas.

We may update these Terms from time to time. When we do, we will post the updated Terms with a revised effective date and notify you via email or in-app notification. Continued use of the Service after changes constitutes your acceptance of the updated Terms.
